Mr. Barkley made a number of mistakes besides driving with alcohol on his breath on New Years Eve:

1.    He spoke with police at all.  His obligation was to produce his license and registration PERIOD.  He should have then said I want a lawyer; if I am not under arrest please let me go.

2.   He agreed to do the field tests:  a collection of junk science coordination tests designed to fail the subject and produce probable cause for arrest.

3.   He continued to talk with police even after being mirandized. 

4.  He thought his statement about oral sex from his passenger would help him.  Mr. Barkley did not undertstand that law enforcement is engaged in a war against anyone who drinks any amount of alcohol and drives.  Law enforcement believes if they destroy enough lives they will stop DUIs.  If Barkley’s marriage is ruined by the disclosure that is seen as acceptable collateral damage in the war on Americans who drink.  A celebrity like Charles Barkley is a great trophy for them.  By releasing this information so quickly law enforcement proves that Charles Barkley is a “great catch”.

The Court gave him ten years in jail with a little under 3 years to serve in prison.

In October of 2007 Kight was found not guilty by reason of insanity on felony charges involving grand larceny and breaking and entering. 

Kight is bipolar and schizophrenic. 

These conditions are not voluntary choices for Kight; he was born with them; we know of no permanent cure.

Kight was committed toWestern  State Hospital but was released in February, 2008.

The newspaper article did not detail how much follow up care Kight received or whether he stayed on his medications.

Kight was apparently able to function or at least stay out of jail until he was arrested in September, 2008 for the DUI and hit and run offenses.

Obviously, Kight was treating his serious mental illness with alcohol which probably brings him some temporary relief.  Perhaps we should spend more time trying to help afflicted persons like Kight and less time jailing them.

Keith S. Webb, a Newport News public school employee was arrested on December 8, 2008 for Driving under the influence of alcohol (DUI).

Webb apparently crashed his vehicle into the rear of several stopped cars.

Webb has continued to work as Executive Director of Plant Services.

The school is still investigating so Webb may lose his job due to a DUI charge.

Officer Jacobs was indicted three days before his DUI arrest for obstruction of justice.

Officer Jacobs was stopped for driving 76 in a 55 mph zone and weaving on Interstate 64.

The arresting Virginia State Police Trooper noted a smell of alcohol and what he termed signs of impairment.

The Trooper did not explain that speeding was not a recognized DWI impairment clue.

Norfolk Police Chief Bruce P. Marquis suspended Officer Jacobs with pay but took his badge and pistol pending the outcome of his trial and the interdepartmental investigation.

I am sure that Officer Jacobs deserves to keep his salary while suspended; I just wish that regular citizens would not be fired for simply being charged with DWI or DUI.
