Yes, he did get special treatment. If anyone else tried to foil a breathalyzer test and it was deemed as a refused test they would have lost their license automatically for 1 year. He is 9 months shy on that verdict. He also backed into a police car, if he was anyone else he would have had a charge affiliated with that as well. This would be the law if any regular citizen would have done the same.

Alcoholics are not the only problem. All kinds of people are released from jail and drive again with a suspended or revoked license. They to kill or injure others. Those harmed turn to the legal profession for relief. Interesting cycle here.
Great way to get your name in the paper.

Why doesn't Maryland do something that actually makes sense to make people safer drivers. How about banning cell phones when driving?

All speed cameras do is make us more dangerous in those zones because drivers will be staring at their speedometers and slamming on their brakes rather than watching the road.

Thank you for writing this very important article.

I'm a juvenile justice advocate from Chicago and am working with an attorney in Mississippi helping a child who received a life sentence at barely age 15. The only expert to testify in his trial was Dr. Hayne. He passed himself off as a "board certified forensics pathologist" which the court accepted without question and the boy's 2 public defenders never questioned. He went on to testify that he knew what "defensive" wounds looked like, even though the boy was being attacked by a much larger man with mental illness who was in a rage. The boy claimed he was being attacked, was in a chokehold and was afraid for his life and had to kill or be killed. But Dr. Hayne testified as if he were there and passed off his opinion that wounds on the victim were defensive in nature saying that the boy was the attacker and the aggressor. I'm wondering what a "defensive wound" looks like (are there special goggles to determine that?) The jury bought it and the boy will die in prison unle ss his PCR is granted, which has a 2% chance in Mississippi. He lost his first appeal a year ago. The boy had no witnesses called on his behalf and the defense called only him, ignoring all medical records showing the grandfather had been diagnosed with mental illness, had violent outbursts against other family members, was suffering from PTSD and possibly Alzheimer's, and his grandmother (the widow) and his father were willing to testify to this, but were never called.

Dr. Hayne in his "supposed" autopsy never tested or perserved brain tissue even though the family was saying they were afraid of the man and he had mental illness. They new the boy did not kill him in cold blood which he was convicted of by a jury. It's another case of the good ole boy Mississippi broken public defender system coupled with a fraudulent Dr. Hayne and a gifted, smart, talented non-violent child with no criminal record spends the rest of his life behind bars.

This child, Brett Jones, and Tyler Edmonds were the two youngest at Walnut Grove Maximum Juvenile Prison, growing up in prison. Tyler went into Protective Custody because of his age, size and vulnerability, but Brett did not. He was put in "D" custody with no freedom of movement and was escorted everywhere in shackles; an 8th grade child. Both learned how to survive the hard way. Luckily, Tyler is facing a new trial because of the amazing perserverence and hard work of his attorney Jim Waide who never gave up. I just wanted you to know, not only does "Dr" Hayne put innocent men behind bars for life and on death row, he puts innocent children there too. He is an equal opportunity destroyer.

Sorry for the rant and thanks for your interest in the very important and incredible story. I hope Mississippi comes out of the swamps and into the 21st Century sometime soon. All cases Dr. Hayne testified in need to be reviewed. I'm glad to see this story is getting some traction around the country. Thank you very much. I've read all of "Reason Magazine" Sr. Editor Radley Balko's (or Boo Radley as I look to call him) work on this issue and I admire him greatly.
