Beth Berg, a Hidalgo County prosecutor, is attempting to have a court dismiss her June 30, 2007 DWI charge.
Prosecutor Berg refused to take the field sobriety tests; she knew they are designed to fail anyone unlucky enough to take them,
The Palmview officer insists that Prosecutor Berg had red, bloodshot eyes, slurred speech and smelled of an alcoholic beverage.
The arresting officer testified that Prosecutor Berg failed to signal a lane change before attempting to enter U.S. Expressway 83 through an off ramp.
Prosecutor Berg made the mistake of admitting that she had consumed several glasses of wine.
The Judge is considering whether the arresting officer’s failure to videotape the event constitutes grounds for dismissal.

Supervisor Kinnear ran off the road in East Bloomfield around 1130PM Kinnear indicated that he regretted his DWI arrest but would not resign: “This happened on my own time; I work hard I play hard.” I wonder if he will get special treatment.

Deputy Sheriff David Adam Goff, of the St. Mary’s Sheriff’s Department was fired on September 4, 2008. Deputy Goff has been charged with a DWI and an assault stemming from a stop on an ATV. Goff had allegedly assaulted the handcuffed civilian. Goff smelled of alcohol and was intoxicated according to a preliminary breath test.
If an ordinary citizen, or a citizen assaulting a police officer, Goff would have done real jail time. Instead, he got to quit his job and move on. You need a good attorney to get breaks for you. Former Farmington New Mexico Police Officer Farhon Smith had DWI and careless driving charges dropped on September 5, 2008. In exchange for the dismissal, Officer Smith agreed to plead no contest to making a false report, failure to give notice of accident and leaving the scene of an accident.
Officer Smith was given 6 months of unsupervised probation. The prosecuting attorney was mystified by a defense used by Officer Smith, “He used an aspect of the law that I didn’t understand”
Sure. Smith had gotten drunk and wrecked his blue Ford Mustang. He then called it in as stolen.
“Fahron was a great cop, he just made a mistake.” I am sure he was and I am sure he deserved the break he got; however, why don’t normal citizens get those same breaks?

Aurora Indiana Police Officer, Jared Dausch, 2006 Officer of the Year, has been charged with DWI and assault.
The Aurora Police Department has suspended Dausch pending the results of these charges. In 2005 Officer Dausch was suspended for 15 days after investigators discovered he was showing compromising pictures of a reserve female officer.
In 2004 Dausch was investigated for allegations of battery on his then pregnant girlfriend.

Marv Teixeira, 72 years old, Carson City Mayor, plead guilty to DWI and was sentenced to 46 hours community service, $650.00 fine and to complete an alcohol awareness class. Texeira’s blood was .14.
Texeira was stopped for driving 50 miles per hour in a 35 mile per hour zone. Speeding of course is not a NHTSA clue for impaired driving.
