Mr. Barkley made a number of mistakes besides driving with alcohol on his breath on New Years Eve:

1.    He spoke with police at all.  His obligation was to produce his license and registration PERIOD.  He should have then said I want a lawyer; if I am not under arrest please let me go.

2.   He agreed to do the field tests:  a collection of junk science coordination tests designed to fail the subject and produce probable cause for arrest.

3.   He continued to talk with police even after being mirandized. 

4.  He thought his statement about oral sex from his passenger would help him.  Mr. Barkley did not undertstand that law enforcement is engaged in a war against anyone who drinks any amount of alcohol and drives.  Law enforcement believes if they destroy enough lives they will stop DUIs.  If Barkley’s marriage is ruined by the disclosure that is seen as acceptable collateral damage in the war on Americans who drink.  A celebrity like Charles Barkley is a great trophy for them.  By releasing this information so quickly law enforcement proves that Charles Barkley is a “great catch”.
