Matthew Randall Lowe, son of Circuit Court Judge Randall Lowe was found guilty of DUI and sentenced on October 21, 2008.
Matthew Lowe had been arrested for DUI at the scene of a one vehicle accident where he flipped his pickup truck while turning around in a driveway.
The breath tester had registered Lowe as having a blood alcohol content of .24 grams per 210 liters of breath.
We actually have no idea what Lowe’s blood alcohol level actually was since according to the state the breath testing gadget is “dated, unstable and unreliable.”
The legislature has mandated a mandatory minimum of 10 days in jail for anyone convicted of having more than a .20 grams per 210 liters of breath or higher.
Lowe only had to do two days instead of the mandatory ten.
I am sure that Lowe deserved the break; however, I wish ordinary tax paying citizens got the same deal.
