Beth Berg, a Hidalgo County prosecutor, is attempting to have a court dismiss her June 30, 2007 DWI charge. 

Prosecutor Berg refused to take the field sobriety tests; she knew they are designed to fail anyone unlucky enough to take them, 

The Palmview officer insists that Prosecutor Berg had red, bloodshot eyes, slurred speech and smelled of an alcoholic beverage. 

The arresting officer testified that Prosecutor Berg failed to signal a lane change before attempting to enter U.S. Expressway 83 through an off ramp. 

Prosecutor Berg made the mistake of admitting that she had consumed several glasses of wine. 

The Judge is considering whether the arresting officer’s failure to videotape the event constitutes grounds for dismissal.
