The autopsy showed the physical damage associated with regular heavy drinking.
There were not skid marks in Deputy Miller’s lane indicating that he did not attempt to brake before impacting with the truck.
Vieyra, a foreign national, had been charged with criminally negligent homicide.
The Police indicate that Deputy Miller’s .27 blood alcohol content and apparent failure to brake had nothing to do with the accident.
