Harrisonburg DWI Attorney Bob Keefer says we need to take better care of Veterans with PTSD who abuse alcohol

As a society we have done a very poor job of caring for our psychologically injured service members returning from Iraq and Afghanistan. 

Many suffer from post traumatic stress disorder (PTSD) which can manifest itself in a variety of symptoms. 

Indeed, the Veterans of America report that one in three Iraq veterans and one in nine Afghanistan veterans will face mental health issues including depression, anxiety or PTSD. 

Normal humans were not made to experience the horror, death and devastation of war.   

Many ailing veterans cope with these issues by drinking – drinking heavily. 

Many have nightmares and night sweats. 

Many veterans find that alcohol helps them cope with their bottomless pain better than the medications prescribed by the Veterans Administration. 

Afghanistan Combat Veteran James Emerick Dean was killed by a Maryland State Police Sniper on December 26, 2006.    J

amie Dean was 29 when police killed him. 

Jamie had served 18 months in Afghanistan between 2003 and 2005. 

He had returned to his childhood home in

Southern Maryland and was diagnosed with PTSD.  Even though Jamie married and tried to live a normal life his order to report for duty inIraq threw him into a deep depression. 

Jamie reported that he knew he would die in Iraq. 

On Christmas 2006, Jamie began to drink heavily. 

He eventually began to trash his house. 

Unfortunately a member of Jamie’s family called the Maryland Police and asked that they do a welfare check. 

When Jamie refused to leave the house the SWAT Team surrounded the house and fired 85 tear gas canisters into the house. 

Jamie pointed a shotgun at an armored vehicle and was killed by a SWAT sniper.

Earl Legg, Jr. was arrested by Harrisonburg Virginia Police for felony hit and run, eluding police, reckless driving and driving on a revoked license. 

Legg, driving his Black Mercedes, apparently hit an embankment with his vehicle before fleeing on foot.   

This accident was the culmination of a brief police chase through Liberty Square. This all happened on August 9, 2008 around midnight.

Harrisonburg DWI Attorney Bob Keefer says lets properly test Olympic Athletes and DWI suspects: the cost of false positives is too high for both.

Weak science wrongly accused US Olympic hopeful Bernard Lagat of blood doping. “The anti-doping agencies don’t know what they are doing, “ said Donald A. Berry, head of the Division of Quantitative Sciences at Texas’ Anderson Cancer Center. The problem is that the science is so weak one cannot always tell if an athlete who tests positive for a banned substance actually doped or not. The anti-doping folks resist discussing their methods because they might be giving out a road map to beat their testing. They also say it would be prohibitively expensive. The problem with secrecy is that without oversight innocent athletes will have their careers ruined with false positives.   

Berry responds to such concerns by saying, “ If we cannot as a society afford to fund that sort of effort, then we ought not to be trying to make these measurements and ruining people’s lives… If we want to do it, then we have to do it right.  Doing it in a half-assed way is not serving anybody.”

 These same concerns are echoed by the companies who sell breath alcohol testing machines. I have had clients testing positive in a urine test for THC and PCP who were cleared by subsequent blood testing.  I have seen a provable false positive DUI on a breath machine as well as a false negative.  I have suspected dozens more but been unable to prove them because further testing was denied. 

Let’s do this right for DUI suspects and Olympic Athletes before we ruin more lives.

Coffee County Georgia Sheriff Carlton Evans committed suicide to avoid arrest by the FBI and the Georgia Bureau of Investigation.  

Sheriff Evans was wanted on federal charges of conspiracy to grow more than 1,000 pounds of marijuana. Sheriff Evans was known to be feisty in his hard work to shut down drug sales in Coffee

County. 

Charges were also brought against others.  Money corrupts law enforcement.  My sympathies to Sheriff Evans’ family.

Detective Baggett operated out of the Jackson Mississippi Police Department.

While working on the Jackson, Mississippi drug task force, Detective Baggett characterized herself as the Number One Narcotics Officer in Jackson. I wonder who Number Two was.

Asset Forfeiture means money; and money is guaranteed to corrupt law enforcement.   For example, the Prince George’s County Maryland Sheriff’s Department hid $45,000.00 in the hopes the department could keep the money. This money had been seized from an alleged drug dealer.  For over seven years the Department kept this money off the book while lobbying for a law change that would let them keep the $45,000.00. The County

Auditor, in an unbiased statement said:  “ We wouldn’t have known it existed if somebody hadn’t told us about it… If their intent was to hide it and sit on it, we would never have found out about it.” Money off books for seven years and they wanted you to know about it?

Harrisonburg DWI Attorney Bob Keefer says regular citizens charged with DWI deserve the breaks police officers get

Joshua Calder, a 29 year old Farmington New Mexico police officer is being investigated for DWI.   Officer Calder wrecked his motorcycle after leaving a local bar on his way to Outback Steakhouse. 

The Officer’s friends say he had one to one and a half beers.   Officer Calder got a lucky break when law enforcement forgot to take his blood for alcohol testing until almost three hours had passed.   

During that almost three hours Officer Calder’s body continues to metabolize the alcohol reducing his blood alcohol level. The Sheriff’s Department noted that “We try to draw it as soon as we can, but treatment comes first.” 

Officer Calder’s friends indicated that the crash was caused by lack of visibility from dust stirred up by another motorist. Officer Calder’s passenger indicated that he was traveling 100 miles per hour in a 45 mile per hour zone.   

Officer Calder has not been relieved of duty, but he is on sick leave due to minor injuries. I am sure Officer Calder deserves the breaks he seems to be getting; I just want those breaks for regular citizens as well.

Waynesboro Virginia DWI Lawyer Bob Keefer says DWI cost Mayor his job

The Berryville Arkansas Mayor Tim McKinney was arrested on May 22, 2008 for possession of marijuana and Driving while Intoxicated (DWI). Mayor McKinney was stopped for driving 72 miles per hour in a 55 mile per hour zone.  If you are regular reader of my blog, you know that speeding is not a NHTSA clue of impaired driving. It makes sense.  If you are impaired you slow down because you are not able to safely operate a vehicle at normal speeds. The Mayor showed a .14 blood alcohol content on the government’s test.  The 55 year old Mayor was forced to retire from his job as a lineman for Entergy Arkansas, Inc. because of the DWI’s effect on his license.  How are we better off with the Mayor losing his job keeping electricity on in Arkansas?  We are not.  You can find information about Bob Keefer’s firm at:  www.BobKeeferLaw.com
