Virginia DUI Lawyer Bob Keefer says what ever happened to innocent until proven guilty?

Some traffic lights were off line for a while due to a July 26, 2008 traffic accident in Harrisonburg, Virginia.  A driver in a van struck a HEC substation and took it off line until repairs could be made. The television reported that the driver was operating under the influence.  That, of course, is a rush to judgment since the person involved has not yet had a trial or an opportunity to defend himself.   Whatever happened to innocent until proven guilty?
