Harrisonburg Virginia Lawyer Bob Keefer says even Judges get caught in the DUI trap

Allen County,

Indiana Circuit Court Judge Thomas Felts made headlines by being arrested on July 18, 2008 for DUI and drunk in public.  Judge Felts is no stranger to DUI charges as he presides over most Allen County DUIs.  This is the first charge against Judge Allen himself.

 Judge Allen, 53, was stopped for failure to use a turn signal.  Then the Judge backed into the Indiana Capitol Police car.  The officer had Judge Felts perform a field test and then recorded that the Judge failed the test.  Judge Felts was then arrested for DUI.   

Upon being tested by the evidentiary breath alcohol tester, Judge Felts registered two invalid samples and was also charged with refusal.  To add injury to injury, the police got a search warrant for his blood from a Marion County Judge.  Judge Felts was subsequently subjected to having a blood sample withdrawn at the

 Judge Felts was released about 11 hours after his arrest.  Judge Felts was elected in 2002 and is presently running for re-election.

Harrisonburg Virginia DUI Lawyer Bob Keefer says LaRussa may have been used as an example in government’s DUI witchtrial

Tony LaRussa, St. Louis Cardinals’ manager was found sleeping in his car at a Jupiter Florida  intersection in March of 2007 during spring training.  LaRussa registered a .09 on the evidentiary breath tester at the police station.  He did poorly on the field tests; however, that may have been due to physical issues and not intoxication from alcohol.  One would expect to see little if any impairment at .09 blood alcohol.  The press did not discuss whether LaRussa suffers from any impairments that might artificially inflate his breath test result such as diabetes or acid reflux.  Acid reflux causes alcohol from the stomach to enter the mouth and inflate the alcohol reading on the machine.  http://www.youtube.com/watch?v=cp-SEs6dxR8&feature=related LaRussa plead guilty in November of 2007, was put on 6 months probation, fined $687.50, complete DUI school and do 50 hours community service.    It was interesting that law enforcement released LaRussa’s videotape.  I am sure that was intended to be as a warning to motorists not to drink and drive.  The system made an example of LaRussa for its purpose:  prohibition under the guise of fighting DUI.LaRussa actually may not have been guilty; however, he made a decision that he would do better rolling over than fighting the system.http://www.bobkeeferlaw.com/dui-dui/fce/vids/Video009/
