Harrisonburg Lawyer says witness believes police inaction killed Terrence Kiel, a DUI suspect

Kiel crashed into a wall, was thrown from the vehicle and pinned underneath the car.  Witnesses heard him moaning so he survived the crash.  The police believe he may have been intoxicated.  The police sealed off the area to await fire department backup.  The police prevented a crowd of people from lifting the car off of

Kiel. 

Estimates are that

Kiel was trapped under the car for around an hour.  The case of death was mechanical asphyxia.  Asphyxia, often referred to as suffocation, usually results from an interruption of breathing due to mechanical blockage of the breathing passages.  What if

Kiel had been removed from under the car in less than an hour?  Would be still be alive?

Harrisonburg Lawyer says watch out for Troopers on the side of the road — don’t run into them!

On June 16, 2008, around 7AM, Virginia State Trooper P.C. Gardner was stuck by a motor vehicle.  The accident occurred on the shoulder of Interstate 81 in Rockbridge County, Virginia.  

Trooper Gardner had completed a routine traffic stop when a passing tractor trailer struck his cruiser.  Trooper Gardner was sitting inside his silver Chevy Impala, emergency lights activated, on the southbound lane shoulder.  Upon hearing the sound of locked tractor trailer wheels rumbling over the rumble strips behind him and glancing in the rearview mirror, Trooper Gardner dived into the passenger seat as his unmarked cruiser was crushed. 

Michael Elliott, was not injured even though the semi jackknifed across the highway.  Elliott has been charged with reckless driving. 

Trooper Gardner was transported to Stonewall Jackson Hospital inLexington, Virginia. 

Despite Virginia’s Move Over Law, Trooper Gardner is the fourth Trooper in three months hospitalized due to being struck by a passing motorist. On May 13, 2008, Master Trooper J.H. Rasnick was inside his cruiser when it was struck by a passing tractor trailer in Botetourt County. 

On February 2, 2008, Trooper K.S. Chapman was stuck by a drunk driver while Chapman was seated in his cruiser in Smyth County. On May 7, 2008, Trooper K.J. Brown was seated in his cruiser when it was struck by a passing motorist on Interstate 66 in NOVA.   

On April 30, 2008, Trooper J.T. Mahalik and a speeder were seated in his cruiser when it was struck by a drunk driver on Interstate 66.  Mahalik’s cruiser caught fire after the crash.  Fortunately, both Trooper Mahalik and the speeder were able to escape the flames.

Harrisonburg Virginia Lawyer says now that is reckless driving

On July 7, 2008, Virginia State Police arrested Michael Christopher Sanford, 18 years of age, for reckless driving, speeding, felony eluding of police, and possession of cocaine and marijuana.

Virginia State Trooper Gary Chafin, initially attempted to stop Sanford for driving 73 in a 55 mile per hour zone on Interstate 581.  Instead of stopping, Sanford exited onto Interstate 81 and accelerated, sometimes traveling as fast as 130 miles per hour.

Sanford then exited onto Thompson Memorial Drive, failed to complete a right turn, left the road way and crashed.  Apparently Sanford was running from police because the car was stolen.  This is reckless driving.

Lawyer practicing in Staunton Virginia says even professional athletes cannot pass roadside DUI Testing

A three time pro bowl NFL player, Lofa Tatupu, was found guilty of DUI on July 7, 2008 in

Washington state.  Tatupu was sentenced to one day in jail and about $1,300 in court costs and fines.

 

Tatupu was arrested on May 10th, after being stopped for driving 50 miles per hour in a 35 mile per hour zone.  Tatupu was arrested for DUI even though speeding is not a NHTSA clue for impaired driving.  That is because most impaired drivers travel slower than the speed limit to compensate for their impairment.  Impaired drivers who exceed the speed limit would demonstrate other signs of impairment.  Tatupu did not.

 

Even professional athletes cannot pass the roadside gymnastics that law enforcement has us perform at the roadside.

Harrisonburg Virginia Lawyer says police wrongfully charge teenager for bringing them cookies

The Attorney for Christian V. Phillips reported that laboratory results proved that no drugs were in the cookies Phillips delivered to Lake Worth, Texas police.  Phillips was being held on a $75,000 bond on a criminal charge of tampering with a food product.

 

Phillips was arrested when police believed they smell marijuana in the cookie basket and an inaccurate test indicated the presence of LSD in the cookies.  Phillips had been delivering the cookies as part of a community service project for Mothers against Drunk Drivers (MADD).  The police assume that everyone is against them and would attempt to poison them – the police rushed to judgment and arrested a teenager who merely baked them cookies.

Harrisonburg VA Lawyer Bob Keefer: Virginia State Police identify reckless driving victim

The identity of the person killed in a July 9, 2008 motor vehicle collision in Newport News, Virginia has been identified by the Virginia Medical Examiner The deceased person was horribly burned when a tractor trailer smashed into a line of stopped cars on Interstate 64. The deceased was Lee K. Trollinger, of Hampton, Virginia.  After being struck by the tractor trailer, Trollinger’sToyota was enveloped in flames.   The damage to Mr. Trollinger was so severe that the identification had to be made by the medical examiner. The state police charged Kenneth Hardy, Sr. of Hagerstown, Maryland, the tractor trailer operator with reckless driving as he looked away from the road to get a drink immediately before the fatal crash.  Trollinger has been stopped in a line of cars merging into the right hand lane due to road construction in the left lane.
