Stuarts Draft Virginia (VA) DUI/DWI Lawyer Bob Keefer: Our CMI breath alcohol testers are not made in America afterall

Saturday, June 28th, 2008

The parts for the Intoxilyzers are made in England.  So much for an American made product.  The devices are merely assembled in the U.S. to qualify for federal government incentives for “made in America”.

CMI, Inc. is a leading manufacturer of breath alcohol testing instruments in the U.S., Canada, and around the world. The company manufactures the Intoxilyzer® brand of evidential instruments using infrared spectrometry alcohol detection technology. The Intoxilyzer® 5000 instrument is used by a majority of U.S. state testing programs for evidential DUI enforcement. CMI also markets a complete line of handheld fuel cell based instruments manufactured by Lion Laboratories Limited, another MPD subsidiary. CMI’s broad array of products is also used extensively in safety-related workplace alcohol testing programs and in nuclear power plant employee testing in the U.S. As the leading alcohol instrument educator/trainer in the industry, CMI has trained more than 15,000 law enforcement officials and breath alcohol technicians. CMI is headquartered in Owensboro, Kentucky.

Lion Laboratories Limited, based in Barry, Wales, United Kingdom, is a subsidiary company of MPD, Inc. and a sister company to CMI, Inc. - both of the United States. Lion manufactures a broad range of breath alcohol testing instruments that use fuel cell sensors (a technology pioneered by Lion) and infrared spectrometry. Together, Lion and CMI represent the largest organization in breath alcohol analysis in the world today, a field in which they are entirely specialized.

Harrisonburg Virginia (VA) DUI Lawyer: Driving under the influence of your cell phone

Saturday, June 28th, 2008

Using a cell phone while driving is clearly more dangerous than driving an automobile with .08 bac.  That level of alcohol does not significantly impair most people; a cell phone distracts everyone.

Female Police Officer involved with gangbanger attempted execution?

Saturday, June 28th, 2008

Police officers are human, subject to the same mistakes and errors as the rest of us.  If this lady can make this sort of mistake why do we believe that police officers are above error, mistakes of memory and mistakes in observation.

Elf arrested for DWI/DUI

Saturday, June 28th, 2008

The video is very interesting.  The Horizontal Gaze Nystagmus (jerky eye test) involves holding a stimulus 12 to 15 inches from the subject’s face.  No exceptions; even for elves.  Watch how far out the officer goes.  Most officers have no idea how to give these tests properly.  What effect did the elf shoes have on the subject?

Retired Trooper charged with DWI in fatal crash

Saturday, June 28th, 2008

Being retired law enforcement does not prevent one from being charged with DWI.  Cases like these are terrible where someone who has helped the public becomes part of the problem.  We cannot rush to judgment since the accused has not been afforded a trial.

White Plains man kills best friend.

Saturday, June 28th, 2008

The death of a young person with his life ahead of him is always terrible.  The death of a young person in a needless car accident may be even more terrible.  The person who was responsible for this tragedy will have 4 to 8 years in prison and the rest of his life to think about the death of his friend.  In our imperfect world that is probably the best we can do to bring justice.

To punish innocent persons because they have alcohol in their systems will not stop such tragedies; it will only cause more through wrongful punishment.

If Sean Taylor cannot pass the roadside DWI tests can you?

Saturday, June 28th, 2008

In 2005 Sean Taylor was arrested for DUI because he did not “stick” the roadside gymnastics also called field tests.  The reality of those so called tests is they are designed to fail the subject.  Anyone who could move like this amazing athlete should be able to pass a field test that is fair to the participant.  Mr. Taylor was found not guilty of the DUI once the Judge saw the video.  But the Trooper arrested him.  Don’t do the field tests; even a professional athlete cannot pass them.
