Augusta County Virginia (VA) Attorney DUI/DWI Attorney Bob Keefer: Who is guarding the guardians?

Sunday, June 29th, 2008
Ex-Seattle police detective Deana Jarrett, 55, briefly held the Washington State breath alcohol test record with a 0.47.  This record was subsequently broken by a Pierce County woman who blew a 0.50.  Blood alcohol levels of this magnitude are considered lethal doses of alcohol. Ms. Jarrett recieved a year in jail followed by three months of home detention for a series of DWIs, two of which involved car crashes.  Ms. Jarrett cried in court, apologizing to the judge and the community while indicating that she was not a menace to society.  Ms. Jarrett was a Seattle police detective for almost 20 years before leaving the Department.  She subsequently worked for the Transportation Security Administration. Ms. Jarrett plead guilty earlier to two DWI charges and a reckless endangerment charge arising from a February 2007 car crash.  She was also found to be in violation of a deferred prosecution for a 2001 DWI charge.

.Jarrett has already served more than 300 days in home detention and about 60 days in jail. She spent the past two weeks in jail after she apparently relapsed, breaking a court order to stay away from alcohol.

The Judge stated, “I think she struggles with a disease that has been winning,”

Hmmm…At least three DUIs involving two car crashes, two probation violations and a record 0.47% blood-alcohol level.  What do you think your sentences would have been?  Home detentions and work release programs?  Or very long stretches of hard time?

Funny how prosecutors and judges suddenly see it as a “disease” when the drunk driver is a cop.  Of course it’s a disease but where is that compassion when the defendant isn’t a cop or a politician?

Page County Virginia (VA) DUI/DWI Lawyer Bob Keefer: The truth will come out about CMI’s breath testers one state at a time

Sunday, June 29th, 2008

CMI which makes the Intoxilyzer series (the 5000 64, 66, 68 and 68EN & the 8000) has hidden behind a copyright claim for years.  Kansas uses the 8000.  Kansas Attorney Jay Norton has finally gotten behind that claim and found the smoking gun.

Following the lead of a Minnesota DWI case, Attorney Norton requested a copy of the purchase contract between

Kansas and CMI.

Under the terms of that contract

Kansas owns all manuals, software and hardware.  Furthermore CMI agrees to indemnify and hold harmless the state from any claims of infringement of copyright or patent.

CMI also agrees that all documents, information and manuals are subject to the Kansas Open Records Act,

Kansas’ Freedom of Information Act (FOIA).  Unfortunately for

Kansas officials hoping to hide from the truth all of those documents are now open to the public.  Attorney Norton has convinced the relevant Court to suppress a breath test because the government did not turn over a manual it knew should be turned over.

We have been working in Virginia to obtain the internal records that will expose the truth about Virginia’s “dated, unstable & unreliable” Intoxilyzer 5000s.  If you have a question about Virginia DUI/DWI see out websites:  http://www.bobkeeferlaw.com; http://www.duidriver.net; http://www.keefercard.com; http://www.recklessdriving.net.  Bob Keefer has been an attorney in Virginia’s Shenandoah Valley for over 25 years.  Our firm covers the Valley especially Harrisonburg VA; Rockingham County VA; Staunton VA; Augusta County VA; Woodstock VA; Shenandoah County VA.  See the Ebooks on our sites.

Page County Virginia (VA) DUI/DWI Lawyer Bob Keefer: Who is minding the store? Police officer arrested for DWI in unmarked car

Sunday, June 29th, 2008

People seem to forget that police officers are subject to the same weaknesses and mistakes that the rest of us are.  This fellow appears to have his share of human weaknesses.  We should all remember that police are subject to the same lapses in judgment and memory that the rest of us experience.
