Fishersville Virginia (VA) DUI/DWI Lawyer Bob Keefer: Why isn’t the Virginia Breath Alcohol Lab accredited like all the other labs?

Why has the Breath Alcohol Lab, that is responsible  for ensuring the accuracy and reliability of breath alcohol results, been unable to obtain accreditation when all these other labs in Virginia have been able to maintain their accreditation (http://www.ascld-lab.org/legacy/aslablegacylaboratories.html#VA) by the ASCLD. These labs are acredited:

Grottoes Virginia (VA) DUI/DWI Lawyer Bob Keefer: Virginia Breath Alcohol Lab attempts to become accredited

It turns out that the Virginia Breath Alcohol lab is not accredited.  While I understand they are racing to obtain the proper credentials now why didn’t the lab have proper accrediation in the past?  Who is responsible for this lapse?  What did the lab fail to do that caused the denial of accrediation?  I would like to know the answers to these questions but I am afraid answers will not be forthcoming.

for Breath Alcohol Calibration Laboratories.
Program applications and guidance entries are applicable on the date of posting unless otherwise indicated.Applicant and accredited laboratories are expected to be in conformance with ASCLD/LAB Board of Directors Interpretations within one hundred twenty (120) calendar days of the date of posting, unless otherwise indicated.

If a requirement number does not appear on this page, that means no current application, guidance or Board interpretation is available.The term “management system,” used throughout ISO/IEC 17025:2005, is defined as “the quality, administrative and technical systems that govern the operations of a laboratory.” ASCLD/LAB customers should apply this definition when reading and interpreting the ISO/IEC 17025:2005 document.

What is ISO 17025?

“Management system” refers to the organization’s structure for managing its processes - or activities - that transform inputs of resources into a product or service which meet the organization’s objectives, such as satisfying the customer’s quality requirements, complying to regulations, or meeting environmental objectives.

ISO 9001 is a generic management standard that can be applied to any business enterprise, public administration, or government department.

Growth in the use of management systems generally has increased the need to ensure that laboratories can operate to a quality management system that is seen as compliant with ISO 9001 as well as demonstrate technical competency. Therefore, ISO 17025 was written to incorporate all the ISO 9001 requirements that are relevant to the scope of testing and calibration services as well as specifying the technical requirements for technical competence.

Testing and calibration laboratories that comply with ISO 17025 will also operate in accordance with ISO 9001.

Spring Hil Virginia (VA) DUI/DWI Lawyer Bob Keefer: New Virginia Laws go into effect on Tuesday, July 1, 2008

As mentioned in this Blog earlier, persons under 21 years of age will stand to lose their license for a year for a blood alcohol content over .02 but less than .08.  The law does nothing to improve the technology of the breath alcohol measuring devices that must discern and correctly quantify such small amounts of alcohol.

Driver’s license issued after Tuesday will be good for eight years, not five. 

Any driver refusing to stop for a police officer who later kills himself in the resulting car pursuit will face 10 years in prison and $100,000 in fines.

Michael Vick’s dog fighting case brought in some new law changes.  Effective July 1st, simply attending a dog fight is a felony. 

Restaurants can now serve sangria, a mix of red wine, fruits, brandy and triple sec.

Adults French kissing an child under 13 years old would face one year in jail, a $2,500 fine and be required to register as a sex offender.

Harrisonburg Virginia (VA) Serious Injury Attorney Bob Keefer: Harrisonburg Woman transported to UVA Hospital after car crash

Brenda Shifflett of Harrisonburg VA was transported to the University of Virginia Medical Center after a June 27, 2008 automobile collision.   

The other driver, Ryan Wood of Waynesboro has been charged with reckless driving  Wood apparently ran a red light at the intersection of West Wolfe and Route 42 in Harrisonburg.

Elf arrested for DWI/DUI

The video is very interesting.  The Horizontal Gaze Nystagmus (jerky eye test) involves holding a stimulus 12 to 15 inches from the subject’s face.  No exceptions; even for elves.  Watch how far out the officer goes.  Most officers have no idea how to give these tests properly.  What effect did the elf shoes have on the subject?

Retired Trooper charged with DWI in fatal crash

Being retired law enforcement does not prevent one from being charged with DWI.  Cases like these are terrible where someone who has helped the public becomes part of the problem.  We cannot rush to judgment since the accused has not been afforded a trial.
