Virginia has joined a number of other states requiring mandatory 12 month loss of license for driving with a BAC of .02 but below .08. This new law will go into effect on July 1, 2008.
Jarvis, a member of the House of Delegates for Goochland, Louisa and part of Henrico, submitted the legislation. He justified the increase in penalties as a method to make the consequences for driving underage with alcohol in your system the same as underage possession of alcohol.
He failed to explain why this was needed since someone guilty of possessing alcohol while driving was also guilty of possessing alcohol. Most officers bring both charges. Jarvis also failed to explain that underage possession qualifes one for first offender and a dismissal of the charge upon successful completion of probation. Underage possession while driving does not allow for first offender treatment, only conviction.
The article then sites to a decrease in the number of underage persons dying between 2001 and 2007 as a reason to increase the penalties against underage persons. MADD then indicates that this enhanced penalty is necessary to get the attention of children not acknowledging that persons between 18 and 21 are not children.
