The Kentucky Supreme Court orders the Accused to be provided access to the Intoxilyzer 5000 source code
Monday, February 11th, 2008CMI, the manufacturer of the Intoxilyzer 5000, an evidentiary breath tester has consistently resisted providing the source code to persons accused of DUI. The problem with that position is that without the source code the Accused can disprove the accuracy of the alleged result. The Kentucky Supreme Court found that the scientific reliability of this breath tester had not been established and that the Accused was entitled to this information so he could make his defense.
